Bar Counsel Notes: Tape recording conversation.
In Maine is it okay for one lawyer to tape/record a conversation with another lawyer or with a client?
The answer depends on which state jurisdiction is involved. In Maine, the answer is generally yes, provided that at least one party - which may be the "calling lawyer" - to the conversation is aware that she/he is being recorded. Advisory Opinion #168 elaborates on this issue and inquiring lawyers are encouraged to review that opinion before proceeding.
