A hearing in the above-referenced matter was convened on September 15, 2017, in Portland, Maine before a duly authorized Fee Arbitration Panel of the Fee Arbitration Commission of the Board of Overseers of the Bar. The Panel was designated to hear the controversy existing between the above-named parties as set forth in the Petitioner's Petition. The members of this Panel were Chair Daniel J. Mitchell, Esq., Steven E. Cope, Esq., and public member Rick Dacri. The Petitioner and Respondent appeared before the Panel and indicated they had reached an agreement regarding the reasonable fees the Respondent should receive for the services he performed for the Petitioner, thus resolving the issues raised by the Petition. The Panel reviewed the financial terms of the parties' agreement, which were reduced to writing and are attached to the accompanying Confidential Addendum. Pursuant to the agreement, the Respondent hereby is awarded $61,500 in fees and costs, subject to the parties' fulfillment of the agreement's terms.
In order to preserve the confidentiality of the materials and information submitted at the hearing, this Award and Determination is accompanied by a separate supplemental Confidential Addendum. In accordance with Maine Bar Rule 7(h), the Confidential Addendum shall be confidential and shall not be open to the public or disclosed to any person except as otherwise set forth in Maine Bar Rule 7(h).
This Award and Determination is in full settlement of all claims submitted to the Arbitration Panel.
